KSA DIRECTORS REPORT

The KSA Boys & Girls Ranch July Finance Report;
Motion to Approve: Sheriff Hampton, 2nd by Sheriff Coffey. The KSA Board approved.
Camp- the Ranch had over 600 kids during this past season. Expenses are up during this period of time, income has increased also during this time period.
Calloway Co. Sheriff Marcum - has a donation to be presented to the Ranch in the amount of $500.00 from the Woodsman Memorial 592.
Court Security Fees- Some sheriffs’ offices are thinking about not providing security for their justice centers. It is AOC belief that if a sheriff does not provide all security, they will lose their $8.00 re-imbursement fee along with the 10.1% from court cost fees. If any sheriffs’ need to discuss this issues any further, please contact the KSA executive director as soon as possible.
Sheriff Cain- KLEC has met and has a roster of all sheriffs’ who are in compliances or non compliant with the CCSO law. Sheriff’s should be receiving a letter with information regarding the status of their CCSO.
Old Business
2008 KSA Conference- The Executive in Owensboro has closed. The conference will be held September 7th through September 13, 2008 in Louisville at the Holiday Inn at 2nd & Broadway. Sheriffs’ will receive between 42 and 45 hours of HB 810 training, and 40 hours of training from DOCJT.
Training at the conference will be given by some guest speakers with outstanding backgrounds. They will be speaking on leadership, management issues, policy and procedures, and ethics.

The KSA will be selling a KSA painting depicting a sheriff helping a child. These paintings will be on sale and can be personalized by the artist at the convention.
New Business
DOCJT class #395- Sheriff O’Donnell will be representing the KSA in Richmond, Kentucky.
E-Warrant- Sheriff Matthew stated that the state e-warrant system will be in place by the first of the year. Scott, Bourbon and Clark County are going to be part of a pilot program for the new system.
Kentucky Sheriff History- Sheriff Marcum addressed the board in reference to a person by the name of Martha Shearer who is writing a book on the history of Kentucky Sheriff’s. If anyone has any facts are interesting stories that could be added to the book, please contact Sheriff Marcum so he can get the information to the author.
KLEC Meeting- Sheriff Cain updated the board on a committee being formed looking at the issue of the low success rate of females being able to pass the physical agility test for entrance into the academy. Sheriff Cain will update the board on any changes or recommendations.
The KSA received correspondences from Mary Jo Phillips and the Florida Sheriffs’ Association on behalf of Buddy Phillips the long time executive director of the FSA. The FSA and Mrs. Phillips sent thank you cards to the KSA for the donation made to the Buddy Phillips memorial fund.
Legislative Updates
Tax Bill- KSA Executive Director updated the board in reference to the sale of tax bills. A committee is being formed by the Department of Revenue in reference to the sale of tax bills. The tax bill becomes delinquent on January 1. The KSA will be represented on this board, along with members of the County Attorney’s Association and County Clerk’s. The KSA will monitor any proposed changes that may be made to the sale of these bills.
Sheriff Aubrey updated the board in reference to the pending litigation of the newly passed retirement bill. The KSA has passed a resolution in reference to moving forward with litigation and to have it filed before September 1, 2008. Senator Tom Buford from Jessamine County stood up on behalf of the KSA and the FOP and read the letter on the Senate floor that was sent to all General Assembly members; Senator Buford was the only General Assembly member who voted no on HB 1.
HB 1 adversely affects everyone in the Commonwealth. All sheriffs need to be aware that after September 1 2008 that the position of Hazardous Duty needs to be re-establishing when a sheriff hires a person who has vacated a Hazardous Duty position. The newly hired deputy would be considered non-hazardous until the Kentucky Retirement Board meets and approves the position to be hazardous duty. The deputy’s hazardous duty status will only take effect from the date that the board approves the request. The board meets quarterly and the hazardous duty will not be retroactive back to the hire date.

Web Site – The KSA is in the process of possibly changing the web site to be hosted by the Kentucky.Gov.

KSA Executive Director Wagner wanted to extend his appreciation to all who have hosted golf outing as of this date. The golf scramble and Fund raising is going very well.
Camp- the camp season is under way; the numbers of kids are up this year. The camper of the week is given n a bike as an award at the end of the week.
KSA Ranch web-site is up and running, you can get to this site via a link from the KSA home web site.
Sheriff Sparrow- Toy r us are willing to donate some excess toys to the ranch, the only thing requested for the toys is a letter from the ranch.
Old Business
2008 KSA Conference- The Executive in Owensboro has closed. The conference will be held September 7th through September 13, 2008 in Louisville at the Holiday Inn at 2nd Broadway.
The room rates and more information will be sent to sheriffs’ via e-mail and posted on the web-site.
The vendor hall is limited to 40 vendors. There is a possibility of vendors going into an over flow room.
The itinerary may change as far as for Friday evening. Sheriff Aubrey is working on a river cruise on the Star of Louisville.
Any sheriff planning on attending the conference, please bring a couple bottles of their preferred beverage of choice.
Sheriffs’ are also requested to bring unique door prizes from their county.
Award nominations will be coming out soon, please return the forms as soon as possible.

KSA Conference- KPOA and NOMI is requesting to have their booth spaced waived.

NSA conference- The NSA conference in Indianapolis 6/28/08-07/03/08, Sheriff Aubrey from Jefferson County is running for Sergeant of Arms. Sheriff’s, deputy’s and family members are asked to volunteer at the convention to help get Sheriff Aubrey elected.
Special Guest- John Ward an artist who does painting for organizations’. A sketch of the initial portrait was presented to the KSA with a sheriff vehicle, a dog and a couple of children in a park type setting. The vehicle is going to be painted white with gold and brown stripe package. The slogan is going to be “Kentucky Sheriff’s Committed to Serve”. The uniform will be the tan shirt and the brown pants.
Motion to accept the painting as presented with the color schemes by: Sheriff Matthews, 2nd by: Sheriff Hammons.
The KSA will receive 500 prints to sell at the conference and these prints can be personalized for a county with an individual name and unit number. The prints are signed and number and will sell at a price between $40.00 and $ 50.00.
The original print will be sold at the 2008 KSA conference in Louisville.
The KSA will sell raffle tickets for this portrait.
Sheriff Wright- Reported on his position on the Governors Executive on the Highway Safety committee, the click it ticket program is going well.
New Business
Kentucky Foreclosure Management Company- Representatives from this company address the board in reference to the Kentucky tax bill sale process and how convoluted the system is. This company with the help of the KSA, the County Attorneys’ association and the county clerks want to change legislation to streamline the system and no entity is cut from any fees or funds entitled to them.
Sheriff Cain asked Kentucky Foreclosure Management to bring back their proposed legislation so the KSA and the other organizations can review the legislation change.
Ky Law Enforcement Memorial Golf Tournament and Hole Sponsorship- Sheriff Cain received a request that the KSA sponsor a hole for the Memorial outing, the cost for the hole sponsorship and a foursome to play is $400.00.

The KSA Board approved:
DOCJT class #393- Sheriff Cain will be the keynote speaker on June 20, 2008 in Richmond Kentucky.
Sheriff Burgett Perry County addressed the board in reference the transportation of non judicial prisoners.
KSA Executive Director Jerry Wagner has met with Vicky Wise from the state about some of these issues. The KSA is going to set up a committee to list some of the issues presented to sheriffs’ throughout the state and transporting prisoners.
Legislative Updates
Bill May gave a list of legislation that passed that he thought sheriffs’ should be aware of. The list includes the following Senate Bills, 16,47,57,58,92,93,118,120,125,136,151,159,203,and SJR 80.
The following is a list of House Bills, 106,168,202,204,211,384,406,408,457,639,676,683,696, and 765.
The KSA is reviewing the new proposed retirement bill that has been submitted to the Governor for a special session.

The KSA Board approved:
KSA Executive Director Wagner wanted to extend his appreciation to all who have hosted golf outing as of this date. A total profit of $ 47,000 has been made for the ranch. Special appreciation extended to Sheriff Gaines and Sheriff Blackburn for raising large amounts of money in their outings.
Camp schedules have been mailed out; if you have a date that needs to be changed, or would like to bring kids with a county surrounding your county, call the Ranch as soon as possible. Sheriff’s and deputies are welcome to come and volunteer their time during the camp season.
All camp counselors have been hired and are going through their training for the upcoming camping season.
Donations- any donation received by the ranch, the sheriff of the county from where the donation was received from will get the donors information. Any person donating $ 100.00 or more will receive a hand written personal letter from the KSA Executive Director.
KSA Associate membership list will be sent to all sheriffs’.

All sheriffs’ and deputies who plan on attending the 40 hour in service training must register with DOCJT. House Bill 810 hours will also be obtained during the in service training.

President Agenda
NSA conference is in Indianapolis Indiana, all Kentucky Sheriffs’ are asked to attend and show their support for Jefferson County Sheriff John Aubrey. Sheriff Aubrey is running for Sergeant of Arms and if he succeeds in his endeavor, he will be in line to become the NSA President. Sheriff Aubrey needs campaign volunteers for his election in Indianapolis, but most of all he need sheriffs there to vote.
KLEC Update- Sheriff’s are having more and more input with the KLEC. Two issues discussed at last meeting.
1st HB 427- relating to KLEFP funding was discussed and the board agreed there where mistakes made. In the future all interested parties are going work together to get the KLEFP fund issues worked out.
2nd There are a low number of female applicants for deputies and police officers positions. The board is looking at changing the standards for female recruits.
Police Memorial Services will be held this week.
Owensboro Lodge # 16 will hold there memorial on Wednesday, May 14th, 2008 at 1900 hours at Wing Avenue Baptist Church (Directly off Hwy 60 East, at 628 Wing Avenue, Owensboro Kentucky.
Kentucky Peace Officers Memorial Service will be held at the DOCJT in Richmond Kentucky on May 21, 2008 @ 11:00 a.m. The KSA would like to be well represented at this event.

2008 NSA Conference- for room reservation in Indianapolis Indiana contact KSA executive Director Wagner.
Camp information has been mailed out; if you have a date that needs to be changed, call the Ranch as soon as possible.
The Golf scramble and the fund raising events have been mailed out to all sheriffs’. If anyone would like to attend please do so. Oldham County Scramble has been added to the calendar, it will June 16, 2008.
Ranch Yard Sale- The old army jeep was sold. The ranch received the fair market value for the vehicle.
KSA Associate Membership- The ranch has received several KSA associate membership applications.
Ranch Financial Report- the report was submitted, there was not enough board members to vote. No Quorum.

Old Business
2008 KSA Conference- Contact Captain Jeff Jones on any questions in reference to 2008 KSA conference in Owensboro.
KSA Life Insurance- The question keeps coming up on seasonal employees and the coverage of the Accidental Death Policy. The Insurance Company has not responded about the seasonal employees. The By-laws of the KSA will have to change and conform to the new coverage that started in 2008.
NSA conference is in Indianapolis Indiana, get housing registration forms to KSA director Wagner.
New Business
Tax Sale- Several question in reference to the tax bill sale. Several Sheriff’s are in the process of being sued are have been informed that they will be sued after the tax sale. If you have any questions please feel free to contact Tom Crawford at the Department of Local Government about how to conduct your sale. See chapter 134.450 of the KRS.
NSA Training- the NSA is putting on training class on Domestic Violence in Hazard Kentucky, May 19 & 20. This is a 16 hour course.
A domestic violence class for Dispatcher class will be held May 21 & 22 at the same location. See information at the bottom of this document
KACO Training- KACO still has spots open for the policy and procedure class. Sheriff Troy Young attended this training and stated it was excellent.
CCDW Photographs- Polaroid has stop making the instant film for the camera that a lot of the sheriffs’ use for their CCDW pictures in their office. Applicants must have a picture that is not a digital picture. This is in the KAR.
Legislative Update
HB 600- This bill is in the free conference committee. The retire, rehire issue would not be addressed by the legislators. If you retire and are rehired by an agency in the Commonwealth who participates in CERS, or KERS, will not be eligible to draw a second pension. The General Assembly will be working on this bill on the last two days of the session on April 14 and 15th. Most cities are for the Senate version of this bill.

HB 427- KLEFP is dead, it is not moving.
HB 309- An act to allow law enforcement officials called away on active duty to still receive KLEFP funding has had its 2nd reading in the Senate, but it has stalled. Firefighters already received the KLEFP fund when they are called away on active duty. Please contact your Senator.
Budget Bill- The state police and dispatcher are in the budget to continue to receive their KLEFP stipend through the general fund.
Constable Bill is dead.
SB 159- An act relating to service animals: A service animal under this new law does not have to be quarantined for 10 days. This bill is on the governor’s desk.
The 10% add on tax bills that drop off after the sheriff’s sell the tax bill was not part of the budget.
Court Security Fee increase was another causality of the budget. The plan was to increase this from $ 9.00 to $ 11.00 over the next two years.

Blue Knights- Motorcycle club of active and retired law enforcement officers donated a check of $ 100.00 to Les Russell FOP lobbyist and retired deputy for the Jefferson County Sheriff’s Office presented check to the KSA Ranch.
Joe Nay the brother of retired Oldham County Sheriff Wally Nay passed away recently.
Legislative Update
HB 600- A letter will be composed and distributed to General Assembly members in reference to issues in this bill relating to retirement. Sheriff Cain and Sheriff Aubrey will sign off on this letter.
This session has been very difficult; the KSA is working on all legislation that may be detrimental to all sheriffs.
The KSA received a check for the month of December from EZ Payment in the amount of $ 57.09 per the agreement with the KSA.

The KSA board decided to take a vote to either support or not to support this bill in its present form. As a result of the vote, the KSA board voted not to support HB 427. Court Security Fees- KSA Director Wagner reported a bill changing the court security fees from $8.00 to $9.00 and then to $11.00 over the next two years is in the process of being filed, and should be done in the next couple of days.
Tax Bill- This bill is in the process of being filed or attached to another bill as an amendment. This will allow the sheriff’s to collect the 10% after the tax sale that now drops off at the time of the sale.
HB-639 an act to allow state police to use the funds from the sale of confiscated firearms to buy vest and tasers for law enforcement agencies.
Constable Bill- David Jones from the constable association contacted Sheriff Cain and wanted to make changes to SB-6 to allow a Constable to be put on the KLEC board.
HB 561 an act relating to Constable and Fees. This bill begins with the statement that it is to pertain to counties with Urban County government, but in the back part of the bills allows Constable to collect fees in all counties.
HB-581 an act to extend the sunset clause on the retirement date
HB-600 an act relating to retirement- Sheriff Aubrey reports that there are some issues that need to be addressed with this bill. One of the major issues is that an agency that hires a retiree will have to pay the employer portion of retirement which is set by the retirement board, but the employee will never receive any retirement benefit from the new employer.

2008 KSA Conference- Sheriff Cain updated the board on the well publicized financial problems with the Executive Inn in Owensboro the site of the conference. The fees and the cost for the sheriffs’ and vendors will be the same as last year. The conference rates are as followed Sheriff $300 if paid by August 15 and $330 after August 15, Former Sheriff $ 125, Deputy $125, and vendors $500 without electric, $575.00 with electric. Room rates are $ 80.00 for doubles and $ 155.00 for suites.

KACO Legislative Reception- Sheriff Cain reported that the event was well attended and the KSA was represented even with the inclement weather throughout the state on the day of the event.
JAG Grant- the KSA is leading all other states in sending letters to Washington in reference to the JAG grant. This information was conveyed from the NSA to the KSA.
Special Olympics sent a letter to the KSA for their support, and on upcoming events for the Special Olympics.
President Cain received request to sit on several boards. President Cain is unable to fulfill the entire request and has filled the board appointment with the following sheriff’s.

The KSA received a letter from John Estill the attorney for the KSA
in reference to a suit which involves Sheriff Boggs from Mason Co, the Circuit Court Judge, and John Estill. This suit has been filed by the Department of Corrections. This suit is about the movement of prisoners by the Department of Correction to other facilities when they have not completed all their court proceedings in the county they are being tried. The Circuit Court ordered the Department of Corrections to return the inmate to Mason Co. and the litigation contends it is the sheriff’s obligation to return the defendant back to the court of jurisdiction.
KSA District meeting have very well attended. Sheriffs’ have been in support of the meetings. There are two district meetings in Western Kentucky to be completed.
Sheriff Korzenborn read a letter from Representative Geoff Davis in support of the JAG Grant and is trying to get the money back into the grant.
Martin Scott FOP President appreciates the cooperation of working with the KSA.
Sheriff Coffee- Spoke about the contract between sheriffs’ and cities for police contract. A letter and the copy of the contract has been sent to John Estill the KSA attorney for review and to assure that the sheriff’s receive the appropriate amount of compensation from the court base revenue funds.

· KSA Associate Membership- The ranch will be sending out post cards and letters to sheriffs' to distribute for a free one year complimentary membership. The window decals are in.
· KSA Executive Director Wagner- Calendars and directories for 2009 or an ongoing work in process, any sheriff wishing to hold a fund raiser for the ranch please contacts the ranch as soon as possible.
· The ranch is going to try and work through the state university to ask for counselors for the upcoming camping season. Counselors will be paid and if possible credit hours towards their degree may be obtained.
· A response from the Attorney Generals office has been sent to the KSA in reference to sheriff's duties, if you would like a copy please contact KSA executive director Wagner.
· Anthony Ouida sent the KSA a thank you card for her Dillard's gift certificate from the KSA.

Sheriff Cain- Reminded the KSA that the Eric law is going to be proposed again this session. It is reference to person or persons involved in an accident and they leave the scene where someone is injured, the punishment will be enhanced to a Felony. (HB-170)
Court Security Fees- KSA director Wagner met with members of leadership in reference changing the court security fees from $8.00 to $12.00. This bill is in the process of being filed.

· 2008 KSA Conference- Sheriff Cain updated the board on the well publicized financial problems with the Executive Inn in Owensboro the site of the conference. Sheriff Cain contacted the Executive Inn and they assured Sheriff Cain there will no problems with the conference.
2008 KSA Conference Training- The training at the 2008 conference will be leadership and ethics. Sheriff Cain requested a motion from the board for guest instructors to speak on leadership and ethics. Sheriff Cain requested an allotment of $ 5,000.00 but would is seeking sponsorship for these speakers.

New Business
· Presentation of Check in the amount of $ 5,000.00 to representatives from Special Olympics made by President Cain and KSA Director Wagner for Corporate Sponsorship for the year 2008. President Cain received the new 2008 Special Olympics Torch Run shirt with the KSA logo on the back of the shirt.
· KACO- Brian Roy from KACO handed out copies of disc for sheriffs with Calea and State Accredited Policy and Procedures. The Disc is available to all agencies upon request.
· Undercover wrist bands from KACO where handed out along with a guide for officers use. KACO will have these bands at the KSA conference.
KACO is having four training sessions on the writing of policy and procedures. Contact Brian Roy or Shawn Weir at 502-223-7667 for dates, times, and locations. KACO has made available upon request a firearms simulator and a driving simulator contact Shawn or Brian for more information.
· JAG Funding- Sheriffs received e-mails in reference to JAG funding. If this funding is cut, several task forces will suffer. Please send letters to local Congressmen.
· Sheriff Cain read a letter from Senator Jones to Sheriff Witten thanking Sheriff Witten and supporting the KSA legislative agenda.
